Coronavirus: which activities are open after the DCPM of March 21 and 11

Following the amendment of the Italian government's DCPM on March 21 and 11, several businesses have been closed except for essential services. The complete list.

Following the amendment of the DCPM of the Italian government dated March 21, which adds to that of March 11 retail commercial activities are suspended.

Activities closed by the DCPM of March 21

  • closure of all retail commercial activities, except those related to public utility services, essential public services, the sale of essential goods, and newsstands;
  • closure of all shopping centers, commercial outlets inside them, and departments selling non-essential goods. Pharmacies, para-pharmacies, and points of sale of food and essentials remain open. Markets, both street and covered, as well as medium and large sales structures are closed;
  • closure of bars, pubs, restaurants of any kind;
  • closure of artisanal service activities (e.g., hairdressers, beauticians, etc.) except for emergency and urgent services;
  • closure of all hotels and any other activities intended for accommodation (e.g., hostels, farm stays, etc.) except those identified as necessary for the fulfillment of public service activities;
  • suspension of all canteen services both in public and private structures;
  • closure of all tertiary and professional services, except those related to public utility and the proper functioning of the sectors mentioned in the previous points. Further suspension is proposed, consequently, of procedural terms and administrative, insurance, etc. obligations.

It is requested that “all activities carried out in an agile work mode” be allowed, the identification of “activities of indispensable necessity” is requested, and it is also specified that “an agreement has already been reached with Confindustria” to “regulate the closure of work activities for companies.”

DCPM of the Italian government dated March 11

ART. 1 (Urgent containment measures of contagion throughout the national territory)

In order to counteract and contain the spread of the COVID-19 virus, the following measures are adopted throughout the national territory:

  1. The following are suspended retail commercial activities, except for the sale of food and essential goods identified in the attachment 1, both within neighborhood commercial outlets and within medium and large distribution, including those included in shopping centers, provided access is allowed only to said activities. Markets are closed, regardless of the type of activity, except for activities directed to the sale of food only. Newsstands, tobacconists, pharmacies, para-pharmacies remain open. Interpersonal safety distance of one meter must always be guaranteed.
  2. The following activities are suspended in catering services (including bars, pubs, restaurants, ice cream shops, pastry shops), except canteens and contract catering continuously based on contract, ensuring a safety interpersonal distance of one meter. Only home delivery catering is allowed in compliance with hygiene and health regulations both for packaging and transport. Furthermore, food and beverage service outlets located in service and refueling areas along roads, highways, and inside train stations, airports, lakeside stations, and hospitals remain open, ensuring an interpersonal safety distance of one meter.
  3. The following are suspended activities related to personal services (including hairdressers, barbers, beauticians) other than those identified in attachment 2.
  4. They remain guaranteed, in compliance with hygienic and sanitary regulations, the banking, financial, insurance services as well as the activities in the agricultural, livestock, and agri-food processing sectors including the supply chains providing goods and services.
  5. The President of the Region, by ordinance pursuant to article 3, paragraph 2, of decree law 23 February 2020 n. 6, may arrange the scheduling of the service provided by Local Public Transport Companies, including non-line services, aimed at reducing and canceling services in relation to the health interventions necessary to contain the coronavirus emergency based on actual needs and solely to ensure minimum essential services. The Minister of Infrastructure and Transport, together with the Minister of Health, may arrange, to contain the coronavirus health emergency, the scheduling with reduction and suspension of interregional automobile services and railway, air, and maritime transport, based on actual needs and solely to ensure minimum essential services.
  6.  Without prejudice to the provisions of article 1, paragraph 1, letter e), of the Prime Minister’s decree of 8 March 2020 and save for activities strictly functional to managing the emergency, public administrations ensure the ordinary performance of their employees’ work in an agile (remote) form, even overriding individual agreements and the informational obligations under articles 18 to 23 of law 22 May 2017, n. 81, and identify the indispensable activities to be performed on-site.
  7. Regarding productive and professional activities, it is recommended that:

a) companies maximize the use of agile work methods for activities that can be performed at home or remotely;

b) paid leave and holidays are encouraged for employees as well as other tools provided by collective bargaining;

c) activities of company departments not essential to production are suspended;

d) anti-contagion safety protocols are adopted and, where it is not possible to maintain interpersonal distance of one meter as the main containment measure, personal protective equipment is used;

e) workplace sanitation operations are encouraged, also using social safety nets for this purpose;

  1.  for only productive activities, it is further recommended that movements inside the sites be limited to the maximum and access to common areas be restricted;
  2. in relation to what is provided in items 7 and 8, agreements between employers’ and union organizations are promoted, limited to productive activities.

10) For all non-suspended activities, the maximum use of agile work modes is recommended.
